In some states, a firearm bill of sale can be a form of registration. Idaho does not require firearms to be registered with the state.

However, it’s a good idea to have an Idaho firearm bill of sale form anyway so that you have proof of the transaction and a record of ownership changing hands.

Who Cannot Purchase a Firearm in Idaho?

Idaho does not have laws restricting the sale or purchase of a rifle, shotgun, or handgun as long as the individual is over 18.

However, anyone who meets the following criteria cannot carry a concealed firearm in the state of Idaho (ID Statutes Section 18-3302):

  • Is under age 21 (Anyone over 18 may buy firearms in a private sale in the state but cannot receive a concealed carry license. Anyone under the age of 18 must have written permission from a parent or guardian to purchase or possess a firearm from a private seller or be in the company of a parent or guardian while they are carrying the firearm.
  • Has been formally charged with a crime punishable by a prison sentence of more than one year.
  • Has been found guilty of a crime punishable by a prison sentence of more than one year.
  • Is a fugitive from justice.
  • Is unlawfully using marijuana or depressant, stimulant, narcotic drugs, or any other controlled substance.
  • Is suffering from diminished mental capacity, mental illness, a grave disability, or is incapacitated.
  • Has been dishonorably discharged from the armed forces.
  • Has received a withheld judgment or suspended sentence for a crime punishable by a prison sentence of more than one year (unless that person has completed probation).
  • Is on probation for a misdemeanor involving the use or threatened use of physical force against a person or their property.
  • Is an illegal alien.
  • Is a person who renounced their  United States citizenship.
  • Is out on bond pending trial, appeal, or sentencing for a crime that otherwise disqualifies them from obtaining a weapons license.
  • Is named in a protection order that restrains them from harassing, stalking, or threatening an intimate partner or child.
  • Meets other criteria that make them ineligible to own or buy a firearm.

There is no waiting period in Idaho to purchase a firearm from a private seller.

If you’re buying from a licensed firearms dealer, there is no waiting period unless your background check is delayed or denied.

No, there is no requirement to notarize a firearm bill of sale in Idaho.

The only oversight the state of Idaho exercises over firearms is the issuance of concealed carry licenses.

How to Apply to Carry a Firearm in Idaho

There is no state permit required for the purchase and possession of firearms. Idaho allows its residents to carry concealed firearms without a permit if they are not disqualified from having a permit.

That said, private citizens in Idaho can still apply for a license to carry a concealed weapon if they want reciprocity in other states. Complete the Idaho Concealed Weapons License Application and complete a firearms safety course.

You’ll then apply in person by taking your application and proof of course completion to your county sheriff’s office.

Submit to fingerprinting and a background check and pay the associated fees.

An Idaho concealed carry license is good for five years and may be renewed online in some counties.

Idaho recognizes valid and unexpired concealed carry permits and licenses from all other states in the United States.

Out-of-state residents are required to carry their permit or license with them when they carry a concealed weapon in Idaho. 

How to Write a Firearm Bill of Sale in Idaho

Step 1 – Local Firearm Laws

Research your local firearm laws. Idaho prohibits private firearms sales to anyone under 18 years old without written permission from a parent or guardian. 

Step 2 – Meeting with Potential Buyer

You may ask to see a potential buyer’s state identification to verify their age or request proof of written parental permission if they are under 18.

Step 3 –  In-Person Exchange

You should meet in person to fill out the firearms bill of sale and legally complete the sale of your firearm.

Step 4 – Firearm Bill of Sale

Complete a firearm bill of sale.

Include the names and contact information of the seller and buyer, the date of the sale, the make, model, and caliber of the firearm, the firearm’s serial number, the purchase price, a description of the condition of the firearm, and any other conditions of the sales agreement.

Summary

The state of Idaho does not require a firearms bill of sale when sold by a private seller.

However, having one protects you by showing that you lawfully sold the weapon and that ownership has changed hands.
