A South Dakota notice to quit for non-compliance is a written message a landlord issues to inform a tenant they’ve violated the lease for something other than non-payment. South Dakota doesn’t mandate landlords to let tenants fix the issue within a certain period before demanding they leave.
Instead, they can simply issue an immediate notice to vacate. However, if the tenant has otherwise been compliant, a landlord can choose to give them a reasonable period to rectify the issue.

Notice Types — A landlord can issue one of two notice types:
- Curable: A curable notice details issues a tenant can fix within a practical timeframe.
- Noncurable: A noncurable notice states a cause for eviction that a tenant can’t fix or one a landlord won’t allow the tenant to remedy.
