A crime and drug free lease addendum is a legal document added to a lease that reinforces the parties’ commitment to maintaining a safe and drug free living environment. This agreement ensures that the tenant commits to not participating in or facilitating criminal activities or illicit drug use on the rental property, protecting the landlord’s investment and the well-being of all tenants.
The landlord reserves the right to terminate the lease immediately if the tenant, their family members, or guests are involved in illegal acts, violence, threats, or the use, sale, or production of controlled substances.
Collecting Evidence
If the landlord suspects or has evidence of the tenant’s involvement in illegal activities, the eviction process may be initiated. The landlord should gather sufficient proof before proceeding:
- A log of any suspicious actions, such as the presence of unknown individuals or unusual behavior.
- Video surveillance in common and shared areas to monitor and record any unauthorized activities.
- Written testimonies and complaints from other tenants, neighbors, or witnesses who can provide information about the suspected illegalities.
- A police report on the tenant’s criminal acts.
While pressing charges to evict isn’t usually required, landlords should notify the police about their concerns.
