An affiant is someone who makes an affidavit and swears to its validity. The term “affiant” is most often used in the courtroom, where an affiant must file an affidavit in certain legal cases that require submission of evidence.
Examples of an affiant in different scenarios:
- As a signatory and witness in front of a notary
- As a signatory of someone else’s behalf for an affidavit as Power of Attorney ( POA ) affiant.
- The individual who files the complaint, in the case of a divorce.
There are many different instances where you might hear this word, like when filling out your taxes, purchases ( in some states ), or talking with your lawyer.
