An Arkansas standard lease agreement defines the rules and regulations of a rental arrangement for a fixed term between a landlord and a tenant for residential property in the state. The agreement further outlines both parties’ maintenance and repair obligations, clarifying who is responsible for routine upkeep and repairs resulting from tenant negligence or intentional damage.
Considerations on Lease Length
- Rental agreements for a duration of more than one year must be written to be enforceable (Ark. Code § 4-59-101).
- If the rental agreement doesn’t specify a set term, the tenancy is week-to-week for tenants paying weekly rent and month-to-month for all other cases (Ark. Code § 18-17-401(c)).
- Terms for oral leases cannot exceed more than one year.
