A Maine medical power of attorney form allows you (the “principal”) to select someone (the “agent”) to make decisions about your health care treatment in the event that you become incapacitated.
Laws
Statute: Title 18-C, Article 5, Part 8: Uniform Health Care Decisions Act of the Maine Revised Statutes.
Signing Requirements: Under §5-803-A, signing a Maine medical power of attorney can be done remotely if the principal is in isolation due to infectious disease. Maine law requires you to have two witnesses sign your medical power of attorney form. However, your form does not need to be notarized (§5-805).
Revocation: To revoke a medical power of attorney in Maine, you must have the capacity to make your own decisions. The document can be revoked in total or partly, in writing or by personally informing the health care provider. If an agent is your spouse and your marriage ends in divorce, annulment, dissolution, or legal separation, the power of attorney is revoked unless otherwise specified in the form (§5-804.)
