Exemptions
The following are exempt from fair housing protections: [2]

- Housing operated by religious organizations or private clubs.
- Housing intended for the elderly.
- Making housing unavailable to a renter/buyer if their presence would pose a direct threat to the safety of other tenants/persons on the property.
- Discriminating against a person who has been convicted for manufacturing or distributing illegal substances.
Security Deposit Limits
- Security Deposit: A landlord can charge no limit to the amount of security deposit. The security deposit does need to be held in an escrow account maintained in a bank or institution that is federally insured. That way, there’s no risk of the landlord losing the security deposit. [3]
- Return of Security Deposits: Upon the termination of the lease, landlords must return the security deposit within 30 days. If any deductions are made for damages or unpaid rent, the landlord must provide an itemized list of the charges and the remaining balance of the deposit.
Pet Deposit
State laws permit landlords to charge a pet deposit. While there is no limit on the deposit amount, property owners must remember they cannot charge a deposit to renters with service assistance animals.
